DESCRIPTION:Please join the Maryland Bankruptcy Bar Association for our February Joint Chapter Meeting which will feature Laura Bouyea and Darek Bushnaq of Venable LLP. \nThe program will tell the story of a complex\, successful real estate bankruptcy.  In the case\, the borrower avoided the appointment of a chapter 11 trustee by agreeing to significant corporate governance changes\, ultimately selling all of their real estate (64 storage units across 10 states) for $588 million\, which sale paid three lenders’ allowed claims in full.  There were complex intercreditor issues between the first lien lender and the 2 mezzanine lenders.  The lenders’ claims were all resolved by 9019 bankruptcy settlements which were approved by the court over the objection of the debtor’s principal.   Venable represented the senior secured note holder in the case. \nThis will be a hybrid meeting with in-person and Zoom options to attend. \nThe in-person option will be hosted by Venable LLP located at 750 E. DESCRIPTION:Please join us on June 30\, 2021 at 12:00 p.m. for a virtual presentation by the United States Trustee Program on the new Chapter 11 periodic reports\, which become effective on June 21\, 2021. \n  \nAssistant United States Trustees Jeanette Rice and Gerard Vetter will provide important information on the NEW Chapter 11 periodic reports. This program will introduce these streamlined\, data-embedded\, uniform forms and detail the procedures for completing\, filing and serving the new monthly operating reports and post-confirmation reports. \n  \nOn December 21\, 2020\, the U.S. Trustee Program (USTP) promulgated a final rule\, “Procedures for Completing Uniform Periodic Reports in Non-Small Business Cases Filed Under Chapter 11 of Title 11.”  The Final Rule\, which is authorized by 28 U.S.C. § 589b\, requires that chapter 11 debtors in possession and trustees — other than small business debtors — file monthly operating reports (MORs) and post-confirmation reports (PCRs) using streamlined\, data-embedded\, uniform forms in every case in every judicial district where the USTP operates. \n  \nThe uniform forms\, and instructions for their use and filing\, which may be periodically updated prior to the effective date\, are available on the USTP’s website: https://www.justice.gov/ust/chapter-11-operating-reports. \n  \nPractitioners need to understand potential changes to applicable filing and service requirements. Unless otherwise provided by local rule\, each report must be filed with the bankruptcy court no later than the 21st day of the month immediately following the covered reporting period. \n  \nWe hope to generate a meaningful and interactive conversation and we hope you will consider joining the United States Trustee Program and your colleagues for this important conversation! \nZoom information will be provided closer to the event.
